In a victory for due process and the rights of law enforcement officers across the nation, former Atlanta police officer Garrett Rolfe received a ruling from the Atlanta Civil Service Board stating he was unlawfully terminated. He now begins the process of being reinstated as a cop.

Rolfe was fired last year following the shooting death of Rayshard Brooks in an Atlanta Wendy’s parking lot. Police were called when an intoxicated Brooks fell asleep behind the wheel in the drive-thru. Rolfe was one of the police officers who responded to the call and questioned Brooks in the parking lot before attempting to arrest him.

Brooks suddenly resisted, fighting both men and taking one of the officer’s tasers. Rolfe pursued, and when Brooks turned and fired at Rolfe with the stolen taser, Rolfe shot and killed him. The entire incident was captured on multiple cameras.

The Wendy’s was subsequently burned down. Fulton County District Attorney Paul Howard filed charges against Rolfe. Meanwhile, mainstream media completely ignored Brooks’ criminal history which included felony cruelty to children.

According to Fox29:

The Atlanta Civil Service Board voted to reverse the termination of Garrett Rolfe, the former Atlanta police officer who fatally shot Rayshard Brooks outside a southwest Atlanta fast-food restaurant last summer.

The Atlanta Civil Service Board concluded after reviewing the case that Rolfe was not afforded his right to due process and revoked his dismissal from the Atlanta Police Department.

“Due to the City’s failure to comply with several provisions of the Code and the information received during witnesses’ testimony, the Board concludes the Appellant was not afforded his right to due process. Therefore, the Board GRANTS the Appeal of Garrett Rolfe and revokes his dismissal as an employee of the APD.”

Rolfe appealed his termination and claimed the city wrongfully terminated him ask for his job back with back pay.

A hearing was held in April where the former officer evoked the Fifth Amendment and did not talk about the deadly shooting of the 27-year-old.

Video from the June 12 incident shows Brooks tussled with two officers when they tried to arrest him on suspected DUI charges. Brooks took one of the officer’s Tasers and then fired that Taser as he ran away. That is when Rolfe shot and killed Brooks.

Former Atlanta Police Department Chief Erika Shields filed a Notice of Proposed Adverse Action on behalf of APD the day following the shooting, the board said. Rolfe’s termination from APD was announced on June 14.

The board’s findings do not determine whether criminal actions took place on the night Brooks was killed.

During an April hearing, Rolfe’s attorney Lance LoRusso argued the city did not follow protocols when officials took action against Rolfe.

“(The city) never gave him an opportunity to state his side of the case prior to terminating him, and that is required,” LoRusso said.

Rolfe is currently on administrative leave, pending resolution of charges, and LoRusso said he is entitled to back pay dating back to June 12.

The panel cited violation of city code in its decision, which states, “An employee against whom an adverse action is to be taken shall be given a written notice of proposed adverse action, signed by the appointing authority or designee, at least ten working days prior to the effective date of the proposed adverse action.”

The Atlanta Civil Service Board determined the city’s actions did not supply evidence to confirm notice of emergency action, and thus did not comply with the required 10-day notice period.

Chris Stewart, an attorney for Brooks’ family, said the family is disappointed by the news of Rolfe’s reinstatement. He said the legal team agrees with Rolfe’s attorneys regarding the city’s procedural shortcomings and finds it “mind-boggling” city officials weren’t aware of the proper procedure to fire an officer.

The city responded with a statement and comments from Mayor Keisha Lance Bottoms. The statement emphasized the board did not make a determination whether or not Rolfe violated APD policies, and the department will assess whether it’s necessary to launch an additional investigation.

“Given the volatile state of our city and nation last summer, the decision to terminate this officer, after he fatally shot Mr. Brooks in the back, was the right thing to do,” Bottoms said. “Had immediate action not been taken, I firmly believe that the public safety crisis we experienced during that time would have been significantly worse.”

Getting to this point was not an easy road for Rolfe. He has been demonized by mainstream media and social media with Democrats, including his own mayor, calling for harsh treatment against him. Death threats have become commonplace for him and all the while he had been fired without due process. That has been reversed now, but there was a time when it seemed like he wouldn’t see justice. Now, he is eligible for back pay and should be able to get his job back.

Should his mayor be punished for denying him due process? According to DailyWire:

Democratic Atlanta Mayor Keisha Lance Bottoms seemed to suggest Wednesday that it was the right decision to bypass Officer Garrett Rolfe’s right to due process as to avoid more rioting.

The City of Atlanta’s Civil Service Board on Tuesday decided to reinstate Rolfe, who was fired days after the fatal shooting of Rayshard Brooks, citing the violation of Rolfe’s right to due process.

Reacting to the decision, Lance Bottoms referenced the “volatile” state of the city of Atlanta at the time Rolfe was fired. Notably, Black Lives Matter demonstrators and other left-wing activists destroyed liberal cities across the nation while protesting and rioting over the deaths of George Floyd and Brooks.

“Given the volatile state of our city and nation last summer, the decision to terminate this officer, after he fatally shot Mr. Brooks in the back, was the right thing to do,” Lance Bottoms said in a statement issued Wednesday.

“Had immediate action not been taken, I firmly believe that the public safety crisis we experienced during that time would have been significantly worse,” she added.

As society becomes increasingly run by Cultural Marxists, it’s good to see occasional wins for justice. Garrett Rolfe did his job appropriately. He should never have been fired. Now, the city of Atlanta finally agrees.

‘The Purge’ by Big Tech targets conservatives, including us

Just when we thought the Covid-19 lockdowns were ending and our ability to stay afloat was improving, censorship reared its ugly head.

For the last few months, NOQ Report, Conservative Playbook, and the American Conservative Movement have appealed to our readers for assistance in staying afloat through Covid-19 lockdowns. The downturn in the economy has limited our ability to generate proper ad revenue just as our traffic was skyrocketing. We had our first sustained stretch of three months with over a million visitors in November, December, and January, but February saw a dip.

It wasn’t just the shortened month. We expected that. We also expected the continuation of dropping traffic from “woke” Big Tech companies like Google, Facebook, and Twitter, but it has actually been much worse than anticipated. Our Twitter account was banned. Both of our YouTube accounts were banned. Facebook “fact-checks” everything we post. Spotify canceled us. Medium canceled us. Apple canceled us. Why? Because we believe in the truth prevailing, and that means we will continue to discuss “taboo” topics.

The 2020 presidential election was stolen. You can’t say that on Big Tech platforms without risking cancellation, but we’d rather get cancelled for telling the truth rather than staying around to repeat mainstream media’s lies. They have been covering it up since before the election and they’ve convinced the vast majority of conservative news outlets that they will be harmed if they continue to discuss voter fraud. We refuse to back down. The truth is the truth.

The lies associated with Covid-19 are only slightly more prevalent than the suppression of valid scientific information that runs counter to the prescribed narrative. We should be allowed to ask questions about the vaccines, for example, as there is ample evidence for concern. One does not have to be an “anti-vaxxer” in order to want answers about vaccines that are still considered experimental and that have a track record in a short period of time of having side-effects, including death. One of our stories about the Johnson & Johnson “vaccine” causing blood clots was “fact-checked” and removed one day before the government hit the brakes on it. These questions and news items are not allowed on Big Tech which is just another reason we are getting canceled.

There are more topics that they refuse to allow. In turn, we refuse to stop discussing them. This is why we desperately need your help. The best way NOQ, CP, and ACM readers can help is to donate. Our Giving Fuel page makes it easy to donate one-time or monthly. Alternatively, you can donate through PayPal as well. We are on track to be short by about $4100 per month in order to maintain operations.

The second way to help is to become a partner. We’ve strongly considered seeking angel investors in the past but because we were paying the bills, it didn’t seem necessary. Now, we’re struggling to pay the bills. We had 5,657,724 sessions on our website from November, 2020, through February, 2021. Our intention is to elevate that to higher levels this year by focusing on a strategy that relies on free speech rather than being beholden to progressive Big Tech companies.

During that four-month stretch, Twitter and Facebook accounted for about 20% of our traffic. We are actively working on operating as if that traffic is zero, replacing it with platforms that operate more freely such as Gab, Parler, and others. While we were never as dependent on Big Tech as most conservative sites, we’d like to be completely free from them. That doesn’t mean we will block them, but we refuse to be beholden to companies that absolutely despise us simply because of our political ideology.

We’re heading in the right direction and we believe we’re ready talk to patriotic investors who want to not only “get in on the action” but more importantly who want to help America hear the truth. Interested investors should contact me directly with the contact button above.

As the world spirals towards radical progressivism, the need for truthful journalism has never been greater. But in these times, we need as many conservative media voices as possible. Please help keep NOQ Report going.
