A Texas jury has dismissed the criminal charge against a man accused of throwing a can of hard seltzer at Sen. Ted Cruz during the Houston Astros World Series victory parade this past.
The jury on Friday returned a “no bill” to Joseph Arcidiacono, 33, according to an NBC News affiliate in Houston.
Arcidiacono was charged in November with aggravated assault with a deadly weapon after he threw two unopened cans at Cruz, who was hit in the neck and chest area as he stood on a parade float.
No bill means that the jury found insufficient evidence to issue an indictment.
Attorneys for Arcidiacono said after the incident that their client was attempting to “toss drinks from his cooler to the Senator during a championship parade.”
When he was arrested for throwing the cans at Cruz, Arcidiacono reportedly told officers: “I know, I’m an idiot. I’m sorry.”
